Release of Liability & Equipment Return

By signing this agreement, I acknowledge that I am voluntarily renting and using fishing equipment provided by Pawleys Fishing Rentals LLC and understand that fishing and the use of fishing equipment involve inherent risks. These risks include, but are not limited to, injuries from hooks, knives, sinkers, and other sharp objects; slips, falls, cuts, punctures, entanglement; exposure to sun, heat, weather, water, wildlife, and changing marine conditions; and risks associated with inexperience, improper use, or misuse of equipment. I knowingly and willingly assume all such risks, whether known or unknown, foreseeable or unforeseeable, even if arising from the negligence of Pawleys Fishing Rentals LLC.

In consideration of being permitted to rent and use fishing equipment, I hereby release, waive, and discharge Pawleys Fishing Rentals LLC, its owners, employees, agents, contractors, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to the rental, delivery, setup, use, or pickup of fishing equipment. This release includes, but is not limited to, claims for personal injury, illness, death, property damage, or loss, to the fullest extent permitted under South Carolina law.

I agree to use all rental equipment in a safe and responsible manner and to follow any instructions or safety guidelines provided. I understand that I am fully responsible for supervising minors at all times and ensuring that equipment is used appropriately. I further agree that I am financially responsible for any equipment that is lost, stolen, or damaged beyond normal wear and tear while it is in my possession.

I acknowledge that Pawleys Fishing Rentals LLC delivers fishing equipment to the location I provide. Once the equipment has been delivered, I assume full responsibility for the equipment until it is retrieved by Pawleys Fishing Rentals LLC or returned in accordance with the rental agreement. I understand that delivery does not include supervision, instruction, or monitoring of equipment use unless otherwise stated.

If I am signing this agreement on behalf of a minor, I certify that I am the parent or legal guardian of the minor and have the legal authority to consent on their behalf. I agree to all terms of this agreement for myself and on behalf of the minor and assume full responsibility for the minor's participation and use of the equipment.

I authorize emergency medical treatment for myself and/or the minor participant if necessary and agree that I am solely responsible for any medical expenses incurred as a result of injury or illness. I understand that Pawleys Fishing Rentals LLC does not provide medical insurance or coverage of any kind.

This agreement shall be governed by and interpreted in accordance with the laws of the State of South Carolina. I affirm that I am at least 18 years of age, have read and fully understand this agreement, understand that I am giving up certain legal rights, and am signing this agreement freely and voluntarily. I agree that this agreement is binding upon me, my heirs, assigns, and legal representatives.
